Terms and Conditions

PREAMBLE

These general terms and conditions of sale are agreed between BENCHMARK UNIPESSOAL LDA, with registered office at Rua António Caixeiro 13, 2350-164 Olaia Torres Novas, tax identification number 513 008 039 and contact number +351 965 248 799, hereinafter referred to as ‘BENCHMARK’, and persons wishing to make purchases through the website www.happywork.pt and manuelalcada.com, hereinafter referred to as ‘User’.

The parties agree that purchases made through the website www.happywork.pt and manuelalcada.com shall be governed exclusively by this contract, excluding any conditions previously available on the website.


ARTICLE 1 – PURPOSE

The purpose of these general terms and conditions of sale is to provide and define all the information necessary for the User regarding the methods of ordering, selling, paying for and delivering purchases made on the websites www.happywork.pt and manuelalcada.com.

These conditions govern all the steps necessary to place an order and guarantee the follow-up of this order between the Contracting Parties.


ARTICLE 2 – ORDER

The User places their order by completing the purchase process presented on the websites www.happywork.pt and www.manuelalcada.com, adding the product(s) or service(s) they wish to order to their shopping basket:

To send their order, the User must complete the information and choose the options available to them throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the tax identification number and name that they want to appear on the invoice for tax purposes).

The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products available for sale, as well as these General Terms and Conditions of Sale, which will be the only ones applicable to the contract thus concluded.

BENCHMARK will honour orders received online only up to the limit of available stocks. If the product is unavailable, BENCHMARK undertakes to inform the User as soon as possible.

The data contained in the invoice is the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes.

Orders are valid for 30 (thirty) days, unless the order is registered under a promotional campaign that defines a different deadline, in which case prices, discounts, promotions and offers cannot be guaranteed beyond this deadline. If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.

ARTICLE 3 – PAYMENT

On the websites www.happywork.pt and www.manuelalcada.com, BENCHMARK offers Users the following payment methods via Easypay - Instituição de Pagamento Lda:

Credit card (Visa, Mastercard); ATM reference;




In the case of payment by credit card, the User's card will be charged immediately after confirmation of shipment of the goods. If any of the products ordered are out of stock, their value will be credited to the User's card after the order is closed.

ARTICLE 4 – DELIVERY


Orders will be delivered within 10 working days of the order being placed. Delivery is carried out by CTT – Correios de Portugal, S.A.

Orders placed in Portugal will not incur shipping costs.

ARTICLE 5 – PRICES


Prices are in euros, including taxes and fees, taking into account the VAT in force on the date of payment of the order.

If there is an increase in the price of any product, the User will be informed immediately and may choose to receive their order (paying the difference) or cancel it.

ARTICLE 6 – CANCELLATION AND RETURNS


The cancellation or return process is handled on a case-by-case basis by BENCHMARK. The request must be sent in writing to the contact email geral@happywork.pt, within 60 days of the order, and the instructions for cancelling or returning the goods will be answered and defined by BENCHMARK, using the same means of communication.

Whenever possible, the return should be made using the same payment method, but if this is not possible, the user must provide proof of payment and account or card ownership so that the refund can be made by bank transfer.

BENCHMARK undertakes to reimburse the User within a maximum period of 30 days.

Returned products must be in saleable condition, i.e. in the same condition in which they reached the User, without any anomalies or damage.
If the value resulting from the exchange of products in an order is lower or higher than the initial value of the order, the conditions for settlement will be indicated by BENCHMARK.

ARTICLE 7 – PRIVACY POLICY


Your data is processed in compliance with the legislation on the protection of personal data. The same, subject to computer processing, will be included in the COMPANY's database(s) and are intended for the registration and presentation of other products and services, as well as institutional information, to be made available by them.

The provision of your data is optional and, in accordance with the law, you have the right to access, rectify and cancel any data that directly concerns you, either in person or in writing, directly to the address on the home page of this website.
